Terms and Conditions – Bulk Rock Definitions

  • "Client": The person or business purchasing dumprock, gravel, or related goods from the Contractor and responsible for payment unless otherwise agreed in writing.

  • "Contractor": Bulk Rock.

  • "Contract": The agreement between the Contractor and the Client for the purchase and supply of goods, incorporating these Terms and Conditions.

  • "Goods": Dumprock, gravel, and any other aggregates or materials supplied by the Contractor.

  • "Terms and Conditions": These terms and conditions of sale, including any written modifications agreed between the Contractor and the Client.

Conditions

  • These Terms and Conditions do not affect the Client’s statutory consumer rights.

  • Variations or special conditions must be agreed upon in writing.

  • The Contractor may correct errors in quotations, invoices, or documents, provided the correction does not fundamentally change the Contract.

Price and Payment

  1. The Client agrees to pay the full contract price plus any applicable taxes.

  2. Payment not received on the due date will incur interest at 10% per month until settled.

  3. Ownership of goods remains with the Contractor until full payment has been received. The Contractor reserves the right to reclaim goods if payment is not made.

  4. Prices are valid for two months from the quotation date. If costs increase beyond the Contractor’s control (e.g., fuel, materials, labor), the Client will be notified before delivery. The Client may cancel the order, paying only for goods already supplied.

  5. Additional goods or services requested will be charged separately and confirmed in writing.

Minimum Orders and Delivery

  1. Minimum delivery: 500kg (half a ton)

  2. Orders smaller than 500kg must be collected by the Client from the Contractor’s depot at 7 Peter road, Roodepoort.

  3. Deliveries are made using 4–8 ton trucks. The Client must ensure suitable access for these vehicles.

  4. If access issues exist, the Client must inform the Contractor before accepting the order. Any additional costs caused by undisclosed access problems will be the Client’s responsibility.

  5. Delivery is limited to offloading next to the delivery truck. The Client is responsible for moving the goods to their intended location.

  6. If the Client instructs Contractor vehicles to enter private property, this is entirely at the Client’s risk. The Contractor will not be liable for any resulting damage or injury.

  7. If delivery is delayed due to events beyond the Contractor’s control, the Contractor will not be liable for related costs or losses.

Product Terms

  1. Availability and Substitution: If products are unavailable, the Contractor may provide a suitable substitute and refund any price difference, or provide a refund at its discretion.

  2. Natural Variations: Dumprock and gravel are natural products; variations in color, size, and texture are expected and do not constitute defects.

  3. Risk Transfer: Risk passes to the Client upon delivery. Products cannot be returned once delivered.

  4. Safety: Goods are not suitable for ingestion by humans or animals. The Contractor disclaims all liability for misuse.

Cancellation

  • Client Cancellation: If the Client cancels an order, they agree to cover any losses or costs incurred by the Contractor.

  • Contractor Cancellation: If the Contractor cancels, it must refund the Client for any prepaid amounts and cover any reasonable losses caused by the cancellation.

Complaints and Customer Satisfaction

  • Complaints must be submitted in writing within a reasonable time after delivery. If products are proven defective, the Contractor will provide a remedy (replacement or refund) at its discretion.

Liability

  • The Contractor shall not be liable for:

    • Delays caused by events outside of its control.

    • Costs or losses from delivery delays.

    • Loss or damage resulting from delivery beyond the agreed offload point.

    • Variations in product appearance, size, or color.

  • Liability is limited strictly to the value of the goods supplied.

Delivery Acceptance

  • The Client or a representative must be present to accept and sign for delivery.

  • Failure to be present may result in additional charges for re-delivery.

Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of South African courts.
